What Does An “Arms Length Transaction” Really Mean ?

In the last few weeks I have been approached by a few potential clients/sellers asking me to be their broker they all had one thing in common, when I got more information they all had the buyers already lined up. All these buyers also had something in common, they either were a friend, business partner or relative. Finally they had the big in common— they were all trying to commit a fraud involving a short sale. Needless to say being a licensed Broker this is not a good thing.  Not only is it a very bad thing I could loose my license or worse. This is called “ NOT BEING” an Arms Length Transaction.

There are a few reasons that you should be aware of exactly what this entails, you may be approached by a friend or a relative offering you quick cash on a deal with no down size or you mat be entertaining the thought to get out of a financial hardship. Whatever the reason don’t, the down side is huge and easy to get caught.

Transactions that must be at “Arms Length” are not limited to short sales but in the article I am posting it is the main issue. In today’s Real Estate market Short Sales are a big part so this practice of trying to beat the system is in front of us all.
